Wakkaz Terms of Service
These Terms of Service govern your access to and use of the Wakkaz website, mobile applications, and stores and your purchase of eyewear and related products from Wakkaz.
By accessing or using our Services, or by placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
Accounts
When you create an account, you agree to provide accurate and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
Orders and Payment
All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for reasons including suspected fraud, pricing errors, or stock unavailability. Prices are listed in the applicable currency and are subject to change without notice. You agree to provide accurate payment information and authorize us to charge the applicable payment method for your order, including any applicable taxes and shipping fees.
Shipping and Delivery
Estimated delivery times are provided for convenience and are not guaranteed. Risk of loss and title for Products pass to you upon delivery to the shipping carrier. We are not responsible for delays caused by carriers, customs, or circumstances beyond our control.
Returns, Exchanges, and Warranty
Returns and exchanges are subject to our Returns Policy, available on our website. Products are covered by any warranty terms specified at the time of purchase; this warranty does not cover damage from misuse, accidents, or normal wear and tear.
We offer a 6-Month Warranty
At WAKKAZ, we stand behind the quality of our eyewear. All WAKKAZ sunglasses are covered by a 6-month warranty from the date of delivery, covering manufacturing defects and faults in materials or workmanship that occur under normal use.
What Our Warranty Covers
Our warranty covers:
- Manufacturing defects
- Faults in the frame or lenses caused by defects in materials or workmanship
- Structural defects that occur during normal use
- Other defects that mean the sunglasses do not meet the quality or performance reasonably expected of them
What Our Warranty Does Not Cover
The warranty does not cover damage resulting from:
- Accidental damage, including dropping, crushing or bending
- Scratches or marks caused by normal use
- Misuse, abuse or improper handling
- Normal wear and tear
- Improper cleaning or storage
- Exposure to chemicals or substances that may damage the frame or lenses
- Unauthorised repairs, modifications or alterations
- Loss or theft of the sunglasses
Making a Warranty Claim
To make a warranty claim, please contact us with your order number and a description of the issue. We may ask you to provide clear photographs or videos of the sunglasses so that we can assess the issue.
Where necessary, WAKKAZ may request that the sunglasses be returned for inspection.
If the issue is determined to be covered by the warranty, the applicable remedy will be provided in accordance with your rights under South African consumer law.
Proof of Purchase
Proof of purchase may be requested when making a warranty claim. Your WAKKAZ order number or original proof of purchase can be used for this purpose.
Consumer Rights
This warranty is provided in addition to and does not limit, exclude or replace any rights you may have under the South African Consumer Protection Act, 2008 (Act 68 of 2008), or any other applicable law.
Nothing in these Warranty Terms & Conditions is intended to waive or restrict any consumer rights that cannot legally be excluded or limited.
Where the Consumer Protection Act applies, consumers retain their statutory rights regarding defective, unsafe or unsuitable goods.
Warranty Repairs
Where a product is repaired under warranty and the repaired product subsequently fails or remains defective within the applicable period, the consumer's rights under the Consumer Protection Act will apply. Section 56 provides specific protection for goods that fail again within three months after a repair.
Intellectual Property
All content on our Services, including logos, designs, text, graphics, images, and software, is the property of Wakkaz and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content.
User Conduct
When using our Services, you agree not to:
- Violate any applicable law or regulation
- Infringe the intellectual property or other rights of any party
- Upload harmful code, malware, or engage in activity that disrupts our Services
- Use automated means to access or scrape our Services without permission
- Provide false information when creating an account or placing an order
- Engage in fraudulent activity, including chargebacks made in bad faith
User-Generated Content
If you submit reviews, photos, or other content to us (including through virtual try-on or styling features), you grant Wakkaz a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, display, and distribute that content in connection with our Services and marketing. You are responsible for ensuring you have the rights to submit such content.
Changes to These Terms
We may update these Terms from time to time. Changes will be effective upon posting to our website, and your continued use of our Services after changes are posted constitutes acceptance of the updated Terms.
